1. Scope and contracting parties
These Terms of Service govern the use of the platform secondhandshop.lu (hereinafter "Platform") between iSOLUTIONS S.à r.l. (hereinafter "we") and platform users (hereinafter "Users"). By registering and/or using the Platform, the User accepts these Terms.
2. Platform function and role
The Platform provides an online marketplace where private users can offer used items for sale and purchase. We are explicitly not a party to the sales contracts concluded between Users on the Platform. We merely facilitate the contact.
3. Registration and user account
Use as a seller and contacting sellers requires registration with a valid email address. The User undertakes to provide truthful information and to keep their access credentials confidential. Only one account per person is permitted. Account transfer to third parties is prohibited. Minimum age for registration: 18 years. For minors, explicit consent of legal guardians is required.
4. Creating and publishing listings
Sellers can publish listings for used items. The following content is prohibited:
- Counterfeit branded goods or fakes
- Weapons, drugs, illegal substances
- Stolen or fenced goods
- Live animals
- Personal data of third parties
- Pornographic or material harmful to minors
- Politically extremist, racist or discriminatory content
- Tobacco, alcohol to minors, prescription medication
- Food, cosmetics or other perishable/safety-critical products without official approval
- Services instead of physical products
- Multiple identical listings (spam)
We reserve the right to remove listings without prior notice that violate these rules, applicable law or public morality.
5. AI-assisted listing creation
The Platform uses artificial intelligence (Anthropic Claude) to automatically generate title, description, category and price suggestion from uploaded photos. These suggestions are non-binding; the seller bears sole responsibility for the accuracy and completeness of the final listing. Errors in AI classification may occur. Private brands, rare models and unusual items may be misidentified — please review before publication and correct if necessary.
6. Seller obligations
The seller assures:
- To have ownership and right of disposal over the offered item
- To describe the condition truthfully
- To disclose physical and legal defects upon handover
- To use only own photos or photos to which they hold image rights
- To fulfill tax obligations themselves (commercial sellers report their activity to the relevant tax office if applicable)
7. Buyer obligations
The buyer is obliged to:
- Treat the seller respectfully
- Communicate promptly and bindingly when interested
- Honor agreed appointments or cancel them in time
- Exercise necessary caution at meetings
8. Recommendations for meetings and handovers
We strongly recommend:
- Meetings in public places
- Simultaneous exchange (goods for cash)
- No advance payment for private sales
- No shipping for larger amounts without security
- If suspecting fraud: report the listing and do not pay
9. Platform liability
We are not liable for:
- Content, accuracy or legality of listings
- Conclusion, performance or settlement of sales contracts between Users
- Defects or damage to purchased items
- Fraudulent acts or breach of contract by other Users
- Loss through shipping
- Property, personal injury or financial damage at meetings
- Short-term technical failures of the Platform
We are only liable for intent and gross negligence. Otherwise, liability is limited to typical, foreseeable damages. This limitation does not apply to damages from injury to life, body or health.
10. Reporting listings
Any logged-in User can report suspicious listings. We review every report and reserve the right to:
- Remove listings or mark them as "under review"
- In case of multiple violations, suspend the user account
- In case of criminal offenses, inform the relevant authorities
11. Account suspension and deletion
We reserve the right to suspend user accounts in case of:
- Violations of these Terms
- Suspicion of fraudulent activity
- Multiple justified complaints from other Users
- Insults or harassment of other Users in chat
The User can delete their account at any time. Upon deletion, personal data is deleted or anonymized. Active conversations with other Users remain visible to the counterparty under the notice "Deleted user".
12. Intellectual property
By posting a listing, the User grants us a simple, worldwide, royalty-free right to store, display and process the contents (texts, photos) within the scope of platform operations — including processing by our AI service providers for automatic classification. Ownership of the contents remains with the User.
13. Pricing and payment
Basic use of secondhandshop.lu is free. Optionally, Users can subscribe to paid Premium packages, the conditions of which are listed separately. The Platform does not charge a commission on sales contracts concluded between Users.
14. Data protection
We process personal data in accordance with our Privacy Policy and the GDPR.
15. Changes to the Terms
We reserve the right to modify these Terms at any time. We will notify of substantial changes by email at least 14 days before they take effect. If the User does not object within this period, the modified Terms are deemed accepted.
16. Applicable law and jurisdiction
Luxembourg law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for disputes is Luxembourg City, where legally permissible.
17. Severability
Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
